Standard Schedule A for Listing and Buyer Representation Agreements

Use the following text in a Schedule A for all Listing Agreements you sign for the brokerage.  Update the list of services to match your business.

We agree to:

Protect each client’s confidential information, including ensuring that a designated representative does not disclose and confidential information of the designated representatives client to any other agent employed by the brokerage or other person, unless the disclosure is authorized by the client or required by law;

Treat the interests of all the Brokerages clients that have entered into Designated Representation agreements in an objective and impartial manner;

Supervise every Designated Representative to ensure they fulfill their duties under the Designated Representation agreement; In the event that a Designated Representative is not able to represent a client, designate a different agent employed by the Brokerage to be the Designated Representative for the client if the client so agrees;

Provide receipts for deposits, accounting of fees and payments as necessary; Communicate with Listing /Co-operating Brokerages and Buyers/Sellers Lawyers to ensure successful completion of transactions, as necessary.

– Professional Market Analysis
– Pricing Recommendations And Strategies
– Staging Consultation
– Stage Your Property (Optional) 
– Arrange For Professional Photography
– Install A For Sale Sign On Seller’s Property
– Post Listing On Local MLS® System
– Post Listing On Toronto Regional Real Estate Board ((TRREB)optional)
– Post Listing On Realtor.ca Website
– Prepare Digital And Paper Marketing Materials. 
– Including Custom Full Colour Feature Sheets/booklets
– Host MLS® Agent Open House (Date & Time To Be Determined)
– Host Public Open Houses (May Be Hosted By Other Realtors Within Brokerage)
– Arrange Agent And Public Showings Through Digital Appointment Software
– Provide Homeowners With Regular Feedback And Updates From All Showings. 
– Provide Weekly Updates On All Internet Traffic Stats 
– Provide Weekly Market Updates
– Negotiate Offer(s) To A Successful Acceptance
– Ensure All Contingencies And Terms Of Any Offers Are Completed In A Timely Manner
– Process Accepted Offers And Deliver Documents To Sellers Professional Service Providers (Lawyer, Accountant) As Required
– Maintain Contact With Seller Throughout The Closing Process To Ensure A Trouble Free Closing
– Maintain Client Confidentiality Throughout The Sales Process
– Other Services To Be Provided As Discussed, Agreed Upon And Documented In This Schedule

We agree to:

Treat the interests of all the Brokerages clients that have entered into Designated Representation agreements in an objective and impartial manner;

Schedule Of Services:

• Initial consultation for Real Estates Needs Analysis and review of the home buying/investing process
• Discuss/Review: Representation and consumer expectations as per: TRESA 2002 legislation
• Discuss/Review standard documentation to be used in the home buying process (copies provided)
• Discuss & Review Financing Pre-approval process
• Discuss referrals to qualified Real Estate Professionals not limited to, Mortgage specialists, lawyers, accountants etc. (no cost & obligation to you)
• Discuss/Review home search and home viewing process
• Present homes that match client’s requirements
• Determining market value of home prior to the offer being submitted
• Prepare all required and necessary offer documents and review with client and or client’s solicitor
• Negotiate offers to acceptance on behalf of the client
• Ensure delivery of deposit and executed copies of offers on our client’s behalf
• Work with our client to complete all due diligence and ensure conditions/dates are met in a timely manner
• Ensure Client’s solicitor receives all offer documents to create closing
• Maintain contact and council clients through contract to close to ensure all questions and concerns are addressed to our client’s satisfaction
• Arrange and conduct a final walk through property prior to closing
• Be available for any last minute issues/consultations to ensure a smooth closing process
• Maintain contact with our client post closing to ensure there are no outstanding issues
